California Senate Bill (SB) 848

Overview

In accordance with California Senate Bill (SB) 848, in response to requests from school employers, California educational institutions (including but not limited to k-12 private and public schools and school districts) are required to disclose whether a current or former employee applying for employment with another school employer was ever the subject of any credible complaints of,  substantiated investigations into, or discipline for, egregious misconduct as defined in SB 848. If the answer is yes, the educational institution must provide all relevant records in its possession regarding the egregious misconduct when responding to the request. 

What information does SB 848 require schools to collect and provide?

Whether the applicant was the subject of any credible complaints of, substantiated investigation into, or discipline for, "egregious misconduct," that were used to support a substantiated investigation.

"Substantiated" means that an investigator investigated a report and determined that it was more likely than not that the conduct in question occurred.

"Egregious Misconduct": A Narrow Definition

What is Egregious Misconduct?

Child abuse or neglect, as defined in CANRA-- physical abuse, sexual abuse, neglect, the willful harming or injuring of a child or the endangering of the person or health of a child, and unlawful corporal punishment or injury; or 

Immoral conduct that would be the basis for the criminal sex offenses or controlled substance offenses would bar employment in a public school.

Applicant Screening Requirements

  • Applicants applying to work at a school with a start date after January 1, 2026, must provide a complete list of all previous educational institution employers via the linked form. Applicants must sign the form for authorization to conduct reference checks.
  • The hiring school must ask every prior educational employer about certain egregious misconduct of the applicant.
  • The prior educational employers must provide information on substantiated reports of egregious misconduct.
  • The hiring school must keep accurate records regarding the screening.
